An advanced contract award notice (ACAN) is a public notice indicating to the supplier community that a department or agency intends to award a contract for goods, services or construction to a pre-identified supplier, thereby allowing other suppliers to signal their interest in bidding, by submitting a statement of capabilities. If no supplier submits a statement of capabilities that meets the requirements set out in the ACAN, on or before the closing date and time stated in the ACAN, the contracting officer may then proceed with the award to the pre-identified supplier.
1. Definition of the requirement:
The Correctional of Service Canada (CSC) has a requirement to contribute to the protection of society by ensuring that appropriate programming is in place when offenders are released. As part of its mandate, CSC requires the availability of community-based cognitive-behavioral programming for conditionally released offenders, to enhance their potential for personal development and assist in their integration as law-abiding citizens. The work will involve the following:
1.1 Objectives:
To deliver programs to offenders referred by the CSC.
1.2 Tasks:
The Contractor’s Facilitator must:
a. Provide training in the specific program and who is actively participating in the Integrated Correctional Program Model (ICPM) certification and quality assurance process.
b. Provide delivery of the requested number of sessions of the Integrated Correctional Program Model - Community Maintenance Programs Multi-target /Sex Offender, or Community Program, or any combination thereof, to offenders referred by CSC, as requested by CSC and according to national directives, policy, guidelines and the ICPM Community Maintenance Multi-Target Program Manual, ICPM Community Maintenance Sex Offender Program Manual and the ICPM – Community Program Manual.
c. Provide the delivery of 2-hour group sessions for up to 10 participants of the Community Maintenance Programs and maximum of 4 participants per year of the Community Program. In addition, the Contractor’s Facilitator must provide one-on-one interventions for participants who were absent during group sessions in order to cover content missed. This is part of the all-inclusive session fee.
d. Prepare and deliver on a continuous intake basis the ICPM – Community Program for untreated offenders according to CSC departmental standards and requirements. The Contractor’s Facilitator must provide the modular Community program on a continuous intake basis. Participants must be able to enter the program at the beginning of any Module from 1-4. Each session must be 2 hours in duration (and may include a break of up to 15 minutes). There are 17 sessions and an additional 4 sex offender specific sessions. The program has a maximum group capacity of 4 participants. The program is designed in five modules with a maximum of 21 sessions per program cycle.
e. Obtain necessary program materials and prepare lesson plans. The Contractor’s Facilitator must adhere to the course content by providing program sessions of the ICPM Community Maintenance Programs and Community Program as outlined in the program manual.
f. Provide classroom space, program equipment and supplies, and all related administrative services. The administrative services include, but are not limited to, printing handouts, returning interview booklets to be filed on the Education and Training files and documenting attendance.
g. Perform the work at the classroom space the Contractor provides.
h. Deliver the programs during the day and in the evenings (on the Contractor’s premises unless otherwise pre-arranged with the project authority), based on the client’s availability and needs. Most recent sessions have been delivered in the evening.
i. Each session must follow the same process (see below). This applies to CMP MT, CMP SO and Community Program:
• Roundtable and introductions (30 minutes)
• Grab bag (optional)
• Structured segment, each focusing on a specific theme and skills set (50-60 minutes)
• Update self-management plan (10 minutes)
• Wrap-up (5-10 minutes)
j. For all individuals who meet the criteria for ICPM CMP MT, CMP SO and Community Program, the facilitator(s) must:
• Conduct a file review
• Complete the pre-program semi structured interview and document its occurrence in a case work record
• Complete pre/post program testing (i.e. GPPM and personal target ratings) and assessment interviews as required, document the interviews’ occurrence in case work records and ratings in OMSR system in accordance with program policy timeframes
• Ensure participants understand and sign (or refuses to sign) the program consent form prior to program commencement while documenting such in a casework record in OMS. The Contractor’s Facilitator must place the consent to participate on the Education and Training File.
• Set up meeting for those participants who failed to attend a session and cover content missed. This will not be counted as an extra session and must be inclusive in the session rate.
• Offenders will participate in a 12-session cycle of CMP MT, CMP SO unless determined otherwise in consultation with the Program Manager at CSC. If it is determined that an offender will require more sessions, the Contractor’s Facilitator must complete an interim report in accordance with the program template.
• Offenders will participate in 17-21 sessions and complete all 5 Modules of the Community Program.
• Forward all reports for review and approval by the Departmental Representative. The Contractor’s Facilitator must also review the report with the participant and document same in a casework record.
k. Consult with or provide feedback to, as required, each participant’s parole officer with reference to the conduct, attendance, the clients’ response to individual’s in-group and individual treatment including gathering collateral parole officer information for the completion of the final report.
l. In the event of a non-scheduled absence from group or individual sessions, provide a written casework record in the Offender Management System within a 24-hour period. If the Contractor’s Facilitator deems that the circumstances surrounding the absence may be a possible security concern, the Contractor’s Facilitator must immediately notify the parole officer, program manager or National Monitoring Center by phone or email.
m. Consult with the offender’s parole officer and Program Manager prior to removing the participant from the program.
n. Should the client’s behavior deteriorate, or should he be in violation of any release conditions while attending these sessions, the Contractor’s Facilitator must immediately inform CSC personnel so appropriate action can be taken to ensure public safety; this action may, result in the temporary removal of the client from the community.
o. As per Commissioner’s Directive 726 – Correctional Programs, the facilitator must complete a casework record in OMS within 1 working day when:
a. There is an offender contact which is not a requirement of the program,
b. An individual interview is completed with the offender,
c. A make-up session has been completed,
d. There is sharing of information regarding offender participation in the program, and
e. If there is significant information for the Case Management Team. Significant information would include but is not limited to the following: Breach of a condition, new offence, harm to self, harm to others, personal problems that impact risk.
p. Enter a monthly casework record to document session dates and numbers for each attending participant. The Contractor's Facilitator must enter this record of attendance prior to the end of each month in the Offender Management System (OMS).
q. Maintain statistical data on each offender as required by National, or Regional, or District Policies, or any combination of the three, and forward this data to NHQ. As part of post program work, the Contractor’s Facilitator must manage all data collected and administered in accordance with the program documentation guide or forward it to the Program Manager or designate for the site.
r. Maintain a program attendance sheet indicating the names of the participants of the program, the session attended, any missed or made up sessions, or both, and notation of case work records entered (which the Contractor must forward with monthly invoice to Project Authority).
s. Advise CSC in writing when changes occur within the delivery of the program, such as a schedule change and facilitator availability.
t. At the request of the Project Authority, the Facilitator(s), or a Contractor designate, for the ICPM – Community Maintenance Program/Community program must attend and provide input to the Correctional Intervention Board (CIB). This communication with CIB assists the correctional intervention and case management process.
u. Provide on-going staff awareness for CSC Staff, if required, on an annual basis.
1.3 Expected results:
The delivery of weekly sessions (52 sessions) of ICPM Multi-Target Maintenance Program, Community Maintenance Program, Sex Offender Community Maintenance Program and Community Program in the St. John's and Stephenville/Corner Brook areas.
1.4 Performance standards:
The Contractor must deliver the ICPM: Community Maintenance Programs/Community Program in accordance with the following documents:

ICPM: Community Program

1.5.2 Paper consumption:
a. Should printed material be required, double sided printing in black and white format is the default unless otherwise specified by the Project Authority.
b. The Contractor must ensure printed material is on paper with a minimum recycled content of 30% and/or certified as originating from a sustainably managed forest.
c. The Contractor must recycle unneeded printed documents (in accordance with Security Requirements).
1.6 Constraints:
1.6.1 Location of work:
a. The Contractor must perform the work at either the contractor’s place of business or a location determined by the Contractor.
b. Travel
i. The Contractor may be required to travel to attend trainings or as requested by the Project Authority.
1.6.2 Language of Work:
The contractor must perform all work in English.

1. The Contractor must, at all times during the performance of the Contract, hold a valid Designated Organization Screening (DOS), and obtain approved Document Safeguarding Capability at the level of PROTECTED B, issued by the Contract Security Program (CSP), Public Works and Government Services Canada (PWGSC).
2. The Contractor personnel requiring access to PROTECTED information, assets, or sensitive site(s) must EACH hold a valid RELIABILITY STATUS, granted or approved by the CSP, PWGSC.
3. The Contractor MUST NOT utilize its facilities to process, produce, or store PROTECTED information or assets until the CSP, PWGSC has issued written approval.
4. The Contractor MUST NOT utilize its Information Technology systems to electronically process, produce, or store PROTECTED information until the CSP, PWGSC has issued written approval. After approval has been granted or approved, these tasks may be performed at the level of PROTECTED B.
5. Subcontracts which contain security requirements are NOT to be awarded without the prior written permission of the CSP, PWGSC.
6. The Contractor must comply with the provisions of the:
(a) Security Requirements Check List and security guide (if applicable), attached at Annex A;
(b) Contract Security Manual (Latest Edition)
2. Criteria for assessment of the statement of capabilities (minimum essential requirements):
Any interested supplier must demonstrate by way of a statement of capabilities that it meets the following requirements:
Experience:
a. The supplier must have at least one (1) year of experience within the last five (5) years prior to the ACAN closing date in project(s) involving counselling, or intervention services with at-risk clients, or both in an organization that delivers services to persons who have been referred to them by a professional, or federal or provincial department.
b. The Facilitator(s) must have at least one (1) year of experience within the last five (5) years prior to the ACAN closing date in assessing human behavior.
c. The Facilitator(s) must have at least one (1) year of experience within the last five (5) years prior to the ACAN closing date in intervening or providing individual support aimed at changing human behavior with various clientele, such as individuals who have: mental illness, been involved in the criminal justice system, been homeless.
d. The Facilitator(s) must have at least 1 year experience in the last five (5) years prior to the ACAN closing date providing facilitation to group(s) aimed at changing human behavior with various clientele such as those who have : mental illness, been involved in the criminal justice system, been homeless.
e. The Facilitator(s) must have at least one (1) year experience in the last one (1) year prior to the ACAN closing date in writing formal documents, or assessments, or both for client(s) for work involving changing human behavior.
f. The Facilitator(s) must have at least one (1) year experience in the last five (5) years prior to the ACAN closing date in understanding correctional programs and standards; understanding the process of change and techniques to deal with resistant clients; assessing client's progress in relation to the objectives of the correctional plan; managing, supporting and motivating clients in individual and/or group settings; reporting on the impact of the program as it relates to the management of the client’s risk; working in cooperation with the Correctional Service Canada (CSC) case management team to identify the client’s needs and contribute to program planning; communicating effectively orally and in writing.
g. The Facilitator(s) must have at least one (1) year experience in the last five (5) years prior to the ACAN closing date in providing individual or group intervention with socially disadvantaged persons and with different populations. (i.e. offender populations, domestic violence, substance abuse counseling, by gender, by culture and language, ageing populations, peoples with disabilities, low functioning, varying treatment needs)
Academic qualifications:
a. The Facilitator(s) must be a graduate from a recognized college or university in a field that focuses on understanding and assessing human behavior (such as a BA in the area of Psychology, Sociology, Social Work, Criminology or Education);
- OR –
b. The Facilitator(s) must have a secondary school diploma and must have at least one (1) year experience in the last five (5) years prior to the ACAN closing date in understanding and assessing human behavior.
The degree must have been obtained from a recognized Canadian university, college or high school, or the equivalent as established by a recognized Canadian academic credentials assessment service, if obtained outside Canada.

3. Applicability of the trade agreement(s) to the procurement
This procurement is not subject to any trade agreement.
4. Set-aside under the Procurement Strategy for Indigenous Business
This procurement is not subject to any set-asides for Indigenous Suppliers.
5. Comprehensive Land Claims Agreement(s)
This procurement is not subject to a Comprehensive Land Claims Agreement.
6. Justification for the Pre-Identified Supplier
There is a limited number of suppliers available to provide program delivery services to meet the reintegration needs of CSC offenders in the community.
The John Howard Society of Newfoundland has historically provided a broad spectrum of programs and services for offenders on conditional release in the community. The JHS has a well-established network of staff that is able to provide a wide variety of services to the offenders. The JHS is able to adapt to changing requirements for programs and the changes that occur in the National policies surrounding programs. They are able to identify and train staff in a timely fashion that would not impact the safe transition of offenders back to the community. The JHS is a key community partner in the safe transition of offenders back to community by assisting in the provision of programs and services in support of the safe reintegration of offenders.
CSC has previously advertised these requirements on the Government Electronic Tendering System, and no tenders were submitted and no suppliers requested participation.
The pre-identified supplier meets all of the minimum essential requirements described in this ACAN.
7. Government Contracts Regulations Exception(s)
The following exception to the Government Contracts Regulations is invoked for this procurement under subsection:
• Only one person is capable of performing the contract.
8. Exclusions and/or Limited Tendering Reasons
This procurement is not subject to any trade agreement.
9. Ownership of Intellectual Property
There are no intellectual property terms in the contract.
10. Period of the proposed contract or delivery date
The proposed contract is for a period of 1 year, from April 1, 2024 to March 31, 2025, with an option to extend the contract for 4 additional 1-year periods.
11. Cost estimate of the proposed contract
The estimated value of the contract, including option(s), is $425,200.00 (GST/HST extra).
