1. Advance Contract Award Notice (ACAN)
An ACAN is a public notice indicating to the supplier community that a department or agency intends to award a contract for goods, services or construction to a pre-identified supplier, thereby allowing other suppliers to signal their interest in bidding, by submitting a statement of capabilities. If no supplier submits a statement of capabilities that meets the requirements set out in the ACAN, on or before the closing date stated in the ACAN, the contracting officer may then proceed with the award to the pre-identified supplier.
2. Definition of the requirement
Provide a secure, heated indoor space accessible from the air side of the Magdalen Islands airport to store two runway brooms. The space must be reserved for the sole use of Transport Canada and its contractor.
This space must be accessible by the site operator and its authorised employees 24 hours a day, 7 days a week.
3. Criteria for assessment of the Statement of Capabilities
Minimum essential requirements
All interested suppliers must demonstrate by means of a statement of capabilities that they meet the mandatory criteria below. If the bidder does not fully demonstrate its capabilities in its statement, the mandatory criteria will be deemed non-responsive and rejected outright.
The rental space must:
(i) be close to the Magdalen Islands airport;
(ii) have quick access to the airport’s runway;
(iii) have a permanent, enclosed structure that is resistant to high winds;
(iv) be secure, heated and reserved for the sole use of Transport Canada and its contractor.
4. Trade agreement
This requirement is subject to the following trade agreements:
(i) Agreement on Internal Trade (AIT), North American Free Trade Agreement (NAFTA), World Trade Organization-Agreement on Government Procurement (WTO-AGP), Canada-Chile Free Trade Agreement (CCFTA), Canada-Peru Free Trade Agreement (CPFTA), Canada-Colombia Free Trade Agreement (CCoFTA), Canada-Panama Free Trade Agreement (CPaFTA), Canada-Honduras Free Trade Agreement (CHFTA), Canada-Korea Free Trade Agreement (CKFTA), Canadian Free Trade Agreement (CFTA), Canada-Ukraine Free Trade Agreement (CUFTA), Comprehensive Economic and Trade Agreement (CETA), Comprehensive and Progressive Agreement for Trans-Pacific Partnership (CPTPP), Canada-United Kingdom Trade Continuity Agreement (Canada-UKTCA).
5. Set-aside under the Procurement Strategy for Aboriginal Businesses
This procurement is NOT subject to a set-aside under the Procurement Strategy for Aboriginal Businesses
6. Comprehensive Land Claims Agreement (CLCA)
This procurement is NOT subject to the CLCA.
7. Justification for the Pre-Identified Supplier
9426-1203 Québec Inc. is the sole contractor who can render the service. The storage space is on land that is adjacent to Transport Canada (TC) land, and is the only space that meets all the requirements and is close to the airport. Due to logistics, safety and SAAQ compliance requirements, it is not feasible to rent space that is not at close distance to the airport. The runway brooms must be available at all times during winter-like conditions. The owner of the chosen space has accepted to rent it to TC.
8. Government Contracts Regulations Exception(s)
The exception to the Government Contracts Regulations is invoked for this procurement under subsection 6(d) - "only one person is capable of performing the work".
9. Reason for limited tendering
Given that there are no other suppliers that can meet the mandatory requirements (i.e. closeness to the airport, permanent enclosed structure that can sustain high winds) for the space, a sole source contract is justifiable.
The sole option is to rent a private hangar that is located next to TC land, and that is within close distance to the airport. Logistics and security requirements make it impossible to rent space that is far from the airport. Runway brooms cannot ride on public roads, and need to be available at all times during winter-like conditions.
Runway brooms are a critical part of safe snow-clearing operations at airports, and must be stored where they can be de-iced when necessary.
10. Intellectual Property
No intellectual property will be created as a result of this agreement.
11. Contact Period
The proposed contract will be from January 1, 2024, to April 30, 2027, with an option period from November 1, 2027, to April 30, 2028.
12. Cost estimate of the proposed contract
The estimated value of the contract is $246,394.00 (excluding heating costs and taxes extra).

14. Suppliers' right to submit a statement of capabilities
Suppliers who consider themselves fully qualified and available to provide the goods, services or construction services described in the ACAN may submit a statement of capabilities in writing to the contact person identified in this notice on or before the closing date of this notice. The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements.
