Project Background
Section 78.1 of the Ontario Energy Board Act, 1998, S.O. 1998, c. 15 Schedule B (OEB Act) and Ontario Regulation 53/05 under the OEB Act (O. Reg 53/05), set out the OEB’s authority to set payment amounts for Ontario Power Generation (OPG) nuclear facilities and certain hydroelectric facilities, including the form, methodology, assumptions and calculations used in setting payment amounts.
OPG is expected to file its 2022-2026 Payment Amounts application in late December 2020 (OPG Application). This application is expected to include requests for approval related to future spending on the Darlington Refurbishment Program (DRP) and approval to recover any overspending on the DRP that has occurred during the 2017-2021 period.
The OEB’s decision in OPG’s 2017-2021 Payment Amounts proceeding accepted the DRP in-service additions for the years 2017-2021. The prudence of any cost overruns associated with the DRP-related in-service additions that occurred during the 2017-2021 period are subject to a prudence review in OPG’s next cost-based payment amount proceeding. In addition, the remaining DRP cost (approx. $7.6 billion) is subject to review in the next cost-based proceeding (EB-2016-0152, Decision and Order, pp. 36-42).
This RFP is issued concurrently with three (3) other Requests for Proposals (RFPs) and one (1) Request for Services (RFS) for expert services related to the OPG Application. Vendors that bid in response to this RFP who also may be interested in submitting bids in response to the other RFPs should consider their capacity to provide services in response to this RFP as well as the other RFPs, taking into account the anticipated volume and pace of work. Vendors should be prepared to work in coordination with the other Vendor(s) selected to support OEB staff on the OPG Application and demonstrate previous successful experience of collaboration with other vendors or consultants.
Objectives
To retain an expert who will review OPG’s 2022-2026 application, specifically OPG’s proposals regarding the DRP (including OPG’s management of the execution phase of the project, requests for approval related to future spending on the DRP, and requests for approval to recover any overspending on the DRP that has occurred during the 2017-2021 period).
Purpose and Scope
An expert is required to ensure that there is adequate testing of OPG’s proposal regarding DRP execution.
As required, the expert will:
- Analyze the evidence and prepare interrogatories to enable the expert to fully assess OPG’s proposals regarding the DRP.
- Participate in any technical conference(s) to follow-up on any details required following the expert’s review of the interrogatory responses.
- Assist in preparing cross-examination for the oral hearing.
- Assist OEB staff in preparing a submission

- The expert is not likely required to draft a report for filing on the record.
- The exact proposals made by OPG with respect to its Darlington refurbishment program will not be known until the OPG Application is filed. After the OPG Application is filed and the successful Vendor is selected the scope of the engagement and Deliverables will be specified in the Consulting Agreement executed by the OEB and the successful Vendor
